These Spark Forms Terms govern the use of the public forms feature offered by Spark CRM (hereinafter “Spark” or “we”), developed and operated by Link Soluções, based in Arapiraca, AL, Brazil. They complement the Spark Terms of Use and Privacy Policy and do not replace them.
1. Definitions
For clarity in this document:
- Spark User (or Spark Customer): an individual or legal entity that maintains an account on the Spark CRM platform on behalf of an organization and creates, configures, publishes, or embeds a Spark Forms form.
- End user: a person who accesses, completes, or submits a form made available by a Spark User — including when the form is shown inside a third-party website or application (for example, via iframe or direct link). The end user does not have a direct contractual relationship with Spark solely by filling out the form.
- Form data: information and responses submitted by the end user through the form flow (including, depending on configuration, contact details, answers to questions, and technical metadata associated with the submission).
2. Roles under the LGPD (Brazilian Data Protection Law)
For the purposes of Brazilian Federal Law No. 13,709/2018 (LGPD):
- Regarding Form data processed on behalf of the Spark User to enable the feature, the Spark User (and the relevant organization) generally acts as Controller toward end users and is solely responsible for defining purposes of processing, choosing the appropriate legal basis, meeting transparency obligations (notices, the customer’s own policies, third-party cookies on the customer’s site, where applicable), and responding to data subject requests (access, correction, deletion, portability, withdrawal of consent, among others).
- Spark predominantly acts as Processor (or in an equivalent support role), limiting processing of Form data to technical instructions arising from the form configuration and platform use, unless applicable law requires Spark to act otherwise.
Express disclaimer: Spark is not responsible for the content of questions, the lawfulness of collection, the adequacy of the legal basis chosen by the Spark User, or subsequent use of Form data (including integrations, exports, messages to third parties, or storage outside Spark). To the fullest extent permitted by applicable law, civil, administrative, labor, consumer, or criminal liability relating to processing of Form data vis-à-vis end users or third parties is attributed to the Spark User and its organization.
3. Acceptance by the end user
By accessing, completing, or submitting the form, the end user declares that:
- They understand that the data provided will be processed for the benefit and under the responsibility of the Spark User who made the form available, under the LGPD and any notices presented by that Spark User in the channel where the form was offered (website, message, ad, etc.).
- Submitting the form is an unambiguous indication that they are aware of this arrangement and, where required by the Spark User or by law, they agree to processing as configured.
Spark does not warrant that the Spark User has provided complete notices to the end user; that remains the Spark User’s responsibility.
4. Embedding on third-party sites (iframe) and the customer’s sites
Spark Forms may be embedded on pages owned by the Spark User or by third parties. The Spark User is responsible for:
- obtaining any authorizations required for embedding and collection in third-party environments;
- complying with privacy policies, terms of use, and cookies applicable to their own website or app where the iframe appears;
- clearly informing the end user who is responsible for processing data collected through the form.
Rendering the form in an iframe or on a Spark-operated domain (for example, sparkforms.com.br) does not transfer to Spark ownership of processing decisions defined by the Spark User.
5. Monitoring, technical logs, and security
To operate, protect, and improve Spark Forms, Spark may, based on legitimate interest, compliance with legal obligations, or performance of a contract, process technical and usage data, including, by way of example:
- access, submission, error, and performance logs;
- session identifiers, Referer origin, user agent, IP address, and similar network data;
- information about embedding context (for example, signals that loading occurred inside an iframe on a site allowed in the form’s configuration);
- signals for fraud prevention, abuse, spam, and information security.
Such processing may occur even when the form is displayed inside digital properties of the Spark User’s customers or third parties, to the extent necessary for secure service delivery. Operational data is also governed by Spark’s Privacy Policy, insofar as it relates to usage and security.
6. Disclaimer of warranties and Spark’s liability
To the maximum extent permitted by Brazilian law:
- Spark Forms is provided “as is” and “as available”;
- Spark does not guarantee business outcomes, conversion rates, uninterrupted availability, or compatibility with every browser or content blocker;
- Spark is not liable for indirect damages, lost profits, or lost opportunities arising from use of the forms by the Spark User or the end user.
Nothing in this document waives non-waivable consumer rights or mandatory rules of the Brazilian Consumer Protection Code (CDC), where applicable.
7. Reports of abusive or illegal content
Forms whose content or use is abusive, offensive, discriminatory, or illegal should be reported by the end user to Spark at compliance@crmspark.com.br, preferably with enough detail to locate the form (for example, page URL, screenshot, or a short description of what happened). Spark may review the report and take steps consistent with these terms, Spark’s general Terms of Use, and applicable law — which does not create an obligation to achieve any specific outcome for the reporter.
8. Data protection officer and data subject contact
- Questions about data processed by the Spark platform (account, billing, security logs): privacidade@crmspark.com.br, as described in Spark’s Privacy Policy.
- Data subject requests regarding Form data collected on behalf of a Spark User should, as a rule, be sent directly to that Spark User (controller). Spark may forward requests when required by law or contract.
9. Changes
We may update these Spark Forms Terms at any time by publishing a new version on this page and changing the “Last updated” date. Continued use of the feature after publication constitutes acceptance of the changes, to the extent permitted by law.
10. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Arapiraca, State of Alagoas, Brazil are elected as the exclusive venue, to the exclusion of any other, however privileged, except for mandatory consumer jurisdiction or other rules of public order.
